Gentleman, start your crazies, a new nominee is in town. Just when you thought it was safe to put the knives away, Justice JP Stevens retires and, uh-oh a new nominee is put forward. This time it is an American-Jewish-Non-Judge, Elena Kagan from, where else, New York. Time to sharpen up again. It is becoming traditional for summer replacements on TV be Senate hearings on Supreme Court nominees. It’s time to “Get Shorty.”
It is too early to call but people are calling it already. The critics on both the left and the right are Googleing all sorts of stuff about the Solicitor General trying to find sound bites (or in this case, printed sentence bites) to use as talking points. The “boss” (with a small ‘b’ as opposed to the big “B”) Limbaugh on his May 10 radio show croaked Kagan to be “a pure academic elitist radical.” No irrational argument wouldn’t be complete without that voice of reason, Glenn (I’ve been abducted) Beck who said on his May 10 radio show “The new justice … has been named, Elena Kagan. Another left activist.” Beck discussed Kagan’s Princeton thesis, claiming that it was a “call to action” for socialists, while show producer Pat Gray said it “sounded like she was endorsing” socialism. In fact, her thesis simply explored historical questions about socialism. Of course that meant that Glenn had to read the whole thing which is difficult when he is busy making up his own definitions to words like “social justice” and desperately tying them somehow to Soviet Communism. Unfortunately for him, his definitions have nothing to do with reality. Moving on, in a May 10 Gateway Pundit post, Jim Hoft called Kagan an “anti-military loon” because she “expelled military recruiters from the Harvard campus in defiance of The Solomon Act.” In fact, Kagan consistently followed the law in her military recruiting policies, and Harvard students had access to military recruiters during her entire tenure as dean.
But one of the best arguments for why we should throw out this nomination comes from the pin-head at the National Review Ed Whelan who writes “Kagan … is such a product of New York City that she did not learn to drive until her late 20s. According to her friend John Q. Barrett, a law professor at St. John’s University, it is a skill she has not yet mastered.” That does it for me. Didn’t drive until her ’20’s? Wow, a socialist non-driver wanting government (public transit) to give her a lift to the market to buy matza. Imagine! This, of course is added to Whelan’s suggestion that Kagan was a prostitute using a quote by G.B. Shaw to back him up but you will have to Google the actual Shaw quote yourself.
I don’t know if she will be confirmed or not, I feel she will be Justice #112 and the 4th woman on the bench. (Maybe even the first allegedly gay justice) Progression comes slowly. I leave you with the words of the great sage Sean Hannity, the guy who talks about Ronald Reagan like an eight year old talks about Superman, who said of judicial nominees under “another” president, “…if a president wins an election, and he has a particular judicial philosophy…So if he has somebody with more of an originalist [sic] mainstream philosophy that he picks for the court, shouldn’t the Democrats go along with that nominee, based on the fact that the Republican won this election?”
Back to the kitchen, folks, check the knife drawer, the Senate hearings will be a great Summer replacement show.
